User Agreement
Before publication, fill in the highlighted operator details. Without the legal name, tax ID, registration number and address, this document is not ready for use.
1. General provisions
This User Agreement (the “Agreement”) governs the relationship between [controller name], Tax ID [INN], registration number [OGRN/OGRNIP], address [address] (the “Operator”, “we”), and the user of the Service (the “User”, “you”).
The Agreement applies to the Osirius project website, launcher, game server and related pages and functions (the “Service”).
By using the Service, registering an account, downloading the launcher or starting the game, you confirm that you have read and accept this Agreement. If you do not agree, stop using the Service.
This Agreement is not a public offer within the meaning of Article 437 of the Civil Code of the Russian Federation unless a specific service expressly states otherwise.
2. Definitions
- Service — the website, launcher, game server, account area, support and other related functions.
- Account — the user’s registered account for accessing the Service.
- Game client — the software downloaded and updated by the launcher for accessing the game server.
- Virtual items — in-game items, currency, bonuses, titles and other intangible elements within the Service.
- Voluntary contribution — voluntary support for the project; it is not mandatory and is not a purchase of goods.
- Server rules — section 5 of this Agreement and any additional rules published for the Service.
3. Access to the Service
Access to the main game experience is free. Access may require registration, installation of the launcher, an internet connection and compliance with technical requirements.
We may change the set of features, rules, interface, balance, in-game economy and technical requirements. We try to give advance notice of material changes affecting paid bonuses.
The Service is provided “as is” and “as available”. We aim for stable operation but do not guarantee uninterrupted access, freedom from errors or preservation of a particular game result on any device.
4. Account
- You must provide accurate information and a valid email address when registering.
- The Service is intended for persons aged 18 and over. If you are under 18, use of the Service is permitted only with the consent of a legal representative.
- You are responsible for keeping your password confidential and for actions performed through your Account, unless you prove that access resulted from our breach.
- You must not create accounts to evade blocks, commit fraud or otherwise breach the rules.
- Transferring, selling, exchanging or pledging an Account to third parties is not permitted without our written consent.
- You may request deletion of your Account through support. Deletion may be irreversible.
5. Server rules
When using the Service, you agree not to:
- use cheats, bots, macros, autoclickers, scripts or other automation that gives an in-game advantage without our permission;
- exploit errors, vulnerabilities or bugs, or conceal them from the administration;
- interfere with the Service, conduct DDoS attacks, scanning, password guessing, bypass access restrictions or technical protection measures;
- distribute malware, spam, phishing links or unlawful materials;
- insult other users, incite hatred, threaten, harass or publish unlawful content;
- impersonate the administration, rights holders or other official persons;
- sell, buy or exchange virtual items or Accounts for real money outside services permitted by the Operator;
- commit fraudulent transactions, dishonest chargebacks or use another person’s payment funds;
- infringe intellectual property, privacy or other rights of third parties.
For a breach, we may issue a warning, restrict features, remove content, or temporarily or permanently block the Account. The measure should be proportionate to the breach and circumstances; we try to explain it upon request.
A block for breaching the rules does not remove mandatory user rights under applicable law and is not an automatic ground to refuse a refund for an error or failure to provide the service.
6. Virtual items and game progress
Virtual items are part of the game experience. They are not money, securities, property in the civil-law sense or a means of payment. You do not acquire exclusive rights to game objects; you receive the ability to use them within the Service.
Virtual items cannot be exchanged for money, withdrawn from the Service or assigned a monetary value. We may change their characteristics, quantity, duration and availability to maintain balance, security and operation of the Service.
If the Service is discontinued, an Account is deleted or blocked for a breach of the rules, virtual items may be lost. This does not limit your rights where the law expressly requires otherwise.
7. Voluntary support for the project
Support for the project is voluntary. A contribution is not a mandatory condition of access to the game and is not a purchase of goods. As a token of appreciation, we may provide in-game bonuses; their composition, amount and terms are stated on the payment page or in published rules.
We do not promise that bonuses will retain their value forever, and we do not sell “victory” or a guaranteed advantage unless expressly stated otherwise. By making a contribution, you understand that supporting the project does not create a sale-of-goods relationship.
The procedure for refunding voluntary contributions, including erroneous, duplicate and failed payments, is governed by the Refund Policy. Those rules apply together with mandatory statutory provisions.
8. Payments
Payments are processed through third-party payment services. By making a payment, you confirm that you act on your own behalf, are of the required age and use lawful funds. The Operator does not store full bank card details.
If a payment is erroneous, duplicated or unauthorised, contact support before filing a chargeback with your bank. A dishonest chargeback after receiving bonuses may lead to account restrictions; this does not remove your right to a lawful refund.
9. Intellectual property
Rights to the game, its client, graphics, music, characters, texts and other elements belong to the respective rights holders. The Operator does not claim rights to those objects and does not act on behalf of the rights holders.
Rights to the website design, texts, launcher, Osirius and multiprof logos belong to the Operator or are used on a lawful basis. You may not copy, distribute or modify these materials without permission, except where expressly permitted by law.
If you send us feedback, ideas or suggestions, you permit us to use them to develop the Service without remuneration. Personal data is processed under the Privacy Policy.
10. Liability
The Operator is liable for its actions to the extent established by law. We are not liable for network failures, actions of providers, payment systems or third parties, unlawful actions of users, or indirect losses and lost profits, unless otherwise required by law.
We do not guarantee that the Service will meet your expectations, operate without errors or work on any equipment. You use the Service at your own risk, but this does not remove consumer rights where they apply.
Nothing in this Agreement excludes liability for intentional breaches, harm to life or health, or other cases where limitation of liability is prohibited by law.
11. Personal data
Personal data processing is governed by the Privacy Policy. We may separately request consent to processing to the extent required for a specific function.
12. Dispute resolution
Disputes are resolved through negotiation. Send a claim to [email protected] with a description and supporting materials. We respond within a reasonable period, usually within 30 calendar days.
If the dispute is not resolved, it is considered in accordance with applicable law. Consumers retain the right to go to court at their place of residence and to exercise other rights under consumer protection law.
Russian law applies, subject to mandatory provisions that cannot be changed by agreement.
13. Final provisions
We may amend this Agreement. A new revision is published on this page with a new date. If a change materially worsens the User’s position, we try to notify the User in advance; continued use after publication means acceptance of the new revision, unless otherwise required by law.
Invalidity of an individual provision does not invalidate the Agreement as a whole. Matters not covered by the Agreement are governed by law.
